Equity Scholar Education

1. Acceptance of These Terms
By booking a session, or otherwise using Equity Scholar Education (“ESE,” “we,” “us,” “our”) you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the platform. We may revise these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. (ontario.ca)
2. Eligibility

Tutors must be at least 18 years old, or at least 13 with verified parent or guardian consent.

Students of any age may participate; those under 18 should review these Terms with a parent or guardian.

All users must provide accurate, current information and keep login credentials secure. (ineedatutor.ca)
3. Account Registration
You agree to:

Provide true, current, and complete information during sign-up.

Update your profile promptly if information changes.

Maintain the confidentiality of your password.

Notify us immediately of any unauthorized use of your account.
4. Services Provided
ESE offers free peer-to-peer tutoring sessions, volunteer-hour tracking, and related academic support tools. We are a nonprofit; no fees are charged for tutoring. Session links are generated through Google Meet, and the website is hosted on Wix.
5. Volunteer Responsibilities

Volunteers tutor without monetary compensation and log hours for community-service credit.

Volunteers are responsible for ensuring they are qualified to teach listed subjects.

Volunteers must not guarantee grade improvements or provide services beyond academic assistance (for example, completing homework on a student’s behalf). (tootor.ca)
6. Student Responsibilities

Attend sessions on time with necessary materials.

Treat tutors with respect and follow academic honesty policies.

Obtain parent or guardian permission if under 18.
7. Code of Conduct (All Users)

No harassment, hate speech, or discriminatory remarks.

No sharing of illegal, copyrighted, or obscene content.

No recording of sessions unless all participants consent and the on-screen notification is visible.

No misuse of another person’s account.
8. Session Recordings
Sessions may be recorded to help students review material and to verify volunteer hours. When recording is active, a clear on-screen notice appears. Recordings are stored for up to two years, after which they are deleted.
9. Intellectual Property

All platform text, graphics, and code are owned by ESE or its licensors.

Tutors retain ownership of lesson materials they create but grant ESE a non-exclusive licence to display them during sessions and store them for review.

Users may not copy, distribute, or reverse-engineer any part of the platform without written permission.
10. Third-Party Services
Our platform relies on Wix (hosting, analytics) and Google Meet (video conferencing). Your use of those services is also governed by their respective terms and privacy policies, over which we have no control. (cira.ca)
11. Privacy
Our Privacy Policy explains how we collect, use, and protect personal information. By agreeing to these Terms you acknowledge you have read the Privacy Policy.
12. Disclaimers

Tutoring is provided as-is without warranties of any kind.

We do not guarantee specific academic results or grade improvements.

ESE is not liable for internet outages, software failures, or the conduct of third-party providers.
13. Limitation of Liability
To the maximum extent permitted by Ontario law, ESE, its volunteers, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform, even if advised of the possibility of such damages.
14. Indemnity
You agree to indemnify and hold ESE and its volunteers harmless from any claims, damages, or expenses arising from your breach of these Terms or misuse of the platform.
15. Termination
We may suspend or terminate your account at any time if you violate these Terms. You may close your account by emailing equityscholareducation@gmail.com. Sections dealing with intellectual property, liability, and dispute resolution survive termination.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be resolved exclusively in the courts located in Toronto, Ontario.
17. Changes to the Platform
We may modify, suspend, or discontinue any feature of the platform at any time without liability to you.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ESE regarding the platform and supersede all prior understandings.
