Terms & Conditions

Equity Scholar Education

1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern the use of Equity Scholar Education (“ESE,” “we,” “us,” “our”), including booking and participating in tutoring sessions.

If the user is under the age of 18, a parent or legal guardian must review and accept these Terms on the user’s behalf. By permitting a minor to use the platform, the parent or guardian confirms acceptance of these Terms and assumes responsibility for the minor’s participation.

If you do not agree to these Terms, do not use the platform. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

Tutors

Tutors must be between 14 and 17 years of age and may participate only with verified parent or guardian consent. Tutors are student volunteers and are not employees of ESE.

Students

Students must be between 9 and 13 years of age and may participate only with parent or guardian permission.

Parents or guardians are responsible for determining whether participation in tutoring sessions is appropriate for their child.

3. Nature of the Service

Tutoring sessions are conducted on a one-on-one basis between student tutors and student learners. Sessions are not live-supervised by ESE.

Parents or guardians may observe tutoring sessions at their discretion. ESE does not provide active monitoring, moderation, or supervision of live sessions.

To facilitate tutoring, ESE provides volunteer tutors with access to limited student profile information through internal tools, including Google AppSheet. This information is used to allow tutors to view available students, select tutoring opportunities, and prepare for sessions.

4. Account Registration and Security

Users and parents or guardians agree to:

  • Provide accurate, current, and complete information during registration

  • Update information promptly if it changes

  • Keep login credentials confidential

  • Notify ESE immediately of any unauthorized account use

Parents or guardians are responsible for activity conducted through a minor’s account.

5. Services Provided

ESE provides free peer-to-peer tutoring sessions, volunteer-hour tracking, and related academic support tools. No fees are charged.

Tutoring sessions are conducted via Google Meet. The ESE website is hosted on Wix.

6. Volunteer Responsibilities

Tutors:

  • Provide tutoring without monetary compensation

  • Log volunteer hours accurately and honestly

  • Represent their academic abilities truthfully

  • Provide academic assistance only and must not complete assignments, tests, or homework on behalf of students

  • Must not guarantee academic outcomes or grade improvements

  • Use student information accessed through the platform or internal tools solely for tutoring purposes and maintain its confidentiality.

7. Student Responsibilities

Students agree to:

  • Attend sessions on time and prepared

  • Treat tutors respectfully

  • Follow principles of academic honesty

  • Use the platform only for lawful and educational purposes

8. Code of Conduct (All Users)

Users must not:

  • Engage in harassment, hate speech, or discriminatory behavior

  • Share illegal, obscene, or infringing content

  • Misuse or attempt to access another person’s account

  • Record sessions without proper consent

Violations may result in suspension or termination.

9. Session Recordings

Tutoring sessions may be recorded for educational review or volunteer-hour verification.

Recording is optional and requires explicit consent from all participants and, where applicable, from parents or guardians, before recording begins. Declining recording does not prevent participation in tutoring.

When recording is active, an on-screen notice will be displayed. Recordings are retained for up to two years and then deleted.

10. Intellectual Property

All platform content, including text, graphics, and code, is owned by ESE or its licensors.

Tutors retain ownership of original lesson materials they create but grant ESE a non-exclusive licence to use, display, and store such materials for educational and operational purposes.

Users may not copy, distribute, or reverse-engineer any part of the platform without written permission.

11. Third-Party Services

ESE relies on third-party services, including Wix and Google Meet. Use of those services is governed by their respective terms and privacy policies.

ESE is not responsible for outages, failures, or actions of third-party service providers beyond its reasonable control.

12. Privacy

Use of the platform is subject to the ESE Privacy Policy, which explains how personal information is collected, used, and protected. By accepting these Terms, you acknowledge that you have read and understood the Privacy Policy.

13. Disclaimers

Tutoring services are provided as-is and as available.

ESE does not guarantee academic results, grade improvements, or educational outcomes.

ESE does not provide professional teaching, counselling, or academic advising services.

14. Limitation of Liability

To the maximum extent permitted by Ontario law, ESE, its volunteers, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform.

Nothing in these Terms limits liability where such limitation is prohibited by law.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless ESE and its volunteers from claims arising from your breach of these Terms or misuse of the platform.

If the user is under 18, this obligation is assumed by the parent or legal guardian on the user’s behalf.

16. Termination

ESE may suspend or terminate access if these Terms are violated.

Parents or guardians may request account closure by emailing equityscholareducation@gmail.com.

Termination does not affect rights or obligations that by their nature survive termination.

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute shall be resolved exclusively in the courts of Toronto, Ontario.

18. Changes to the Platform or Terms

ESE may modify or discontinue features at any time. Terms may be updated periodically, with the effective date revised accordingly.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ESE regarding use of the platform.
